Fairfax Underage DUI Lawyer
Prevent a single mistake from tarnishing your future
We all know not to drink and drive, but everyone makes mistakes – especially young people. If you or a loved one have been charged with underage DUI in Fairfax and surrounding areas in Northern Virginia, you need an effective, aggressive defense lawyer on your side.
The NoVa Law Firm can help. Attorney Eric Clingan has nearly 20 years of experience fighting DUI charges and winning cases in Fairfax and throughout Northern Virginia.
Legal limits on underage DUI
Sometimes called Baby DUI or Baby DWI, Virginia’s underage DUI law applies only to drivers under the legal drinking age of 21, and has nothing to do with intoxication. The law refers to underage driving after illegally consuming alcohol. Whereas the legal blood alcohol content (BAC) for legal drinkers is 0.08, the limit for Baby DUI is much lower at 0.02.
An underaged driver may feel completely sober and think nothing of getting behind the wheel. But that driver will face severe penalties if they are pulled over by the police and their BAC turns out to be 0.02 or higher.
Underage DUI is a Class I Misdemeanor and has the potential to change your life for the worse. Moreover, Baby DUI can come with other criminal charges, such as:
- Minor in possession of alcohol
- Distributing alcohol to other minors
- Child endangerment
- Possession of false identification
Long term consequences of a Baby DUI
If police officers found that your BAC fell between 0.02 and 0.08, you need an attorney to defend you in court to prevent the inconveniences and stigma associated with dealing with a conviction that carries these penalties:
- A fine of $500 or more
- Loss of driving privileges for up to one year
- Up to one year in jail
- Mandatory referral to VASAP
In an underage DUI where the driver has a BAC over 0.08, the driver is subjected to the same penalties as a legal drinker with a DUI in Fairfax.
When facing a DUI or DWI charge, some people experience a feeling of resignation and simply want to give up their rights and face the legal consequences of their actions.
But they soon learn that the fallout doesn’t end with a fine and a license suspension.
An underage DUI leaves a mark on your criminal record that stays with you for life. Your car insurance company may drop your policy and refuse to insure you, or it will increase your rates to an unpayable amount. You may have trouble getting a job where there is a background check involved, and a DUI conviction could prevent you from attending college or job training as well as your eligibility for scholarships and financial aid. The consequences are not inevitable. Police officers make mistakes. Let us find them.
