Legal limits on underage DUI
Sometimes called Baby DUI or Baby DWI, Virginia’s underage DUI law applies only to drivers under the legal drinking age of 21, and has nothing to do with intoxication. The law refers to underage driving after illegally consuming alcohol. Whereas the legal blood alcohol content (BAC) for legal drinkers is 0.08, the limit for Baby DUI is much lower at 0.02.
An underaged driver may feel completely sober and think nothing of getting behind the wheel. But that driver will face severe penalties if they are pulled over by the police and their BAC turns out to be 0.02 or higher.
Underage DUI is a Class I Misdemeanor and has the potential to change your life for the worse. Moreover, Baby DUI can come with other criminal charges, such as:
- Minor in possession of alcohol
- Distributing alcohol to other minors
- Child endangerment
- Possession of false identification
Long term consequences of a Baby DUI
