Penalties for drug use, possession, manufacturing and distribution vary depending on their controlled substance classification. The Virginia Drug Control Act places controlled substances into categories called schedules. These classifications are similar to the categories in the federal Comprehensive Drug Abuse Prevention and Control Act of 1970.
Virginia state law has a program that allows people who are charged with a first-time drug offense to be placed on probation. If they complete a treatment or education program, perform community service, and remain drug and alcohol free during their probation, their case will be dismissed. This option is called the 251 disposition program.
